Buyer-default cause → MSME Samadhaan before the Facilitation Council in parallel, since the recovered interest funds the settlement.

Enforcement risk while an MSME proposal is pending in Tamil Nadu

A pending OTS does not stay SARFAESI. Madras HC is proactive with writs where auctions are conducted without proper Rule 8(6) notice — a 30-day clear notice defect regularly leads to auction being set aside. Where a 13(2) notice has been issued, we file the 13(3A) reply inside the 15-day window and, if 13(4) possession follows, a Section 17 SA at DRT Chennai (I, II, III), DRT Coimbatore, DRT Madurai, with a writ before the Madras High Court reserved for jurisdictional defects.
